While Xiao Tong applies rigorous engineering methodology and industry best practices to every engagement, we do not guarantee specific performance outcomes, financial results, or business metrics. System performance depends on numerous factors beyond any single vendor's control, including client infrastructure, third-party dependencies, operational practices, and evolving threat landscapes.

4.3 Limitation on Professional Advice

Content provided on this Website, including blog posts, white papers, case studies, and technical descriptions, is for informational purposes only and does not constitute professional engineering advice. Do not make business or technical decisions based solely on Website content. Consult directly with one of our engineers for advice specific to your environment.

THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF XIAO TONG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY.

10. Indemnification

You agree to defend, indemnify, and hold harmless Xiao Tong and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Website; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your User Submissions caused damage to a third party.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law principles.

11.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good-faith negotiations between the parties. If the dispute cannot be resolved through negotiations within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the China International Economic and Trade Arbitration Commission (CIETAC). The arbitration shall be conducted in Zunyi, Guizhou Province, China, in the English language.

11.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING.
